terms of service
these terms govern your use of folk, operated by Nozomio, Inc. by creating an account, subscribing, or using folk, you agree to these terms.
folk
folk is a personal AI you can talk to through supported messaging channels. folk may browse the web, use tools, connect to services you authorize, write code, schedule work, remember context, and take actions you request.
you are responsible for the instructions you give folk and for reviewing important outputs before relying on them. folk is not a substitute for professional legal, medical, financial, or safety advice.
accounts
eligibility. you must be at least 13. if you are under 18, you need permission from a parent or guardian. characters and the gallery are for adults only: you must be 18 or older to create or chat with characters (see below).
identity. you must provide accurate login information and keep your account secure.
responsibility. you are responsible for activity on your account and for complying with laws that apply to your use.
subscriptions
folk is a subscription service. two plans exist, each as a monthly or yearly auto-renewing subscription: folk pro (full access to folk) and folk max(the same, with higher usage capacity). the exact price for your country and billing period is always shown before you buy.
if you subscribe inside the iOS app, payment is charged to your Apple Account at confirmation of purchase. on the US App Store the prices are $9.99/month or $99.99/year for folk pro, and $99.99/month or $799.99/year for folk max; both folk pro plans include a 3-day free trial for eligible new subscribers, shown on the purchase screen. the subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within 24 hours before the period ends. manage or cancel it anytime in your device's Settings → your name → Subscriptions (or App Store → your profile → Subscriptions); deleting the app does not cancel it. any unused portion of a free trial is forfeited when you purchase a subscription.
if you subscribe on the web, folk pro is $9.99/month or $99.99/year unless a different price is shown at checkout. first-time subscribers receive a free trial on either billing period (its length is shown at checkout; a payment method is collected upfront and nothing is charged until the trial ends), after which Stripe automatically charges the payment method on file unless you cancel before the trial ends. other subscriptions are charged immediately at checkout. subscriptions renew automatically at the interval shown at checkout (monthly or yearly) until canceled. you can cancel from settings → billing → manage on Stripe.
after cancellation - on either billing platform - access usually continues until the end of the paid billing period. we do not provide refunds for partial periods unless required by law or stated otherwise at checkout; purchases made through Apple are refunded by Apple under its own policies (reportaproblem.apple.com).
on web billing, if a yearly payment fails, we may move you to the monthly price for the same plan and bill that instead, so your service keeps running rather than being cut off. we will tell you when this happens, and you can switch back to yearly or cancel at any time from settings → billing. Apple-billed subscriptions follow Apple's own billing-retry rules.
referral program
folk may offer rewards for referring new subscribers. rewards are earned only when a referred friend becomes a paying subscriber and stays past any refund window, are subject to verification, and may be paid as cash (through our payout partner, which may require identity verification) or as folk credit. reward amounts and eligibility can change or end at any time for future referrals; earned rewards are honored. self-referrals, fake accounts, spam, and paid-ad arbitrage forfeit rewards. referral rewards are separate from App Store purchases and are not redeemable for in-app content.
acceptable use
you may not use folk to:
- break the law or violate someone else's rights.
- harass, threaten, exploit, or harm people.
- send spam or unauthorized messages.
- attack, probe, overload, or bypass the service or another user's sandbox.
- use connected services or API keys in ways their providers prohibit.
- resell folk or provide access to others without our written permission.
we may suspend or terminate accounts that violate these terms or create risk for the service, users, or third parties.
your content and connected accounts
you keep ownership of messages, files, memories, credentials, and other content you provide. you give us the limited permission needed to host, process, transmit, and display that content so we can operate folk.
when you connect a third-party service, you authorize folk to use that service as needed to perform your requests. those services have their own terms, and you are responsible for following them.
we do not train AI models on your conversations, files, memory, or connected-account content. see the privacy policy for details.
characters and the gallery
characters are AI. each one is fictional, generated from the description its creator wrote, and everything a character says is fiction. fan-made characters based on existing works or public figures are made by folk users and are not affiliated with, endorsed by, or sponsored by any rights holder, studio, publisher, or person.
you must be 18 or older to create a character or chat with one. we ask you to confirm this in the app, and we may remove access to characters from any account we believe belongs to a minor.
publishing to the gallery. when you publish a character, it becomes visible to other folk users: its name, picture, tagline, greeting, description, and tags, along with your handle (or your first name if you have not chosen a handle). public listings can also be found through the share link and by search engines. by publishing you:
- grant folk a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute the character and its picture so we can operate the gallery, share links, and previews. the licence ends when you unpublish or delete the character, except for copies in backups and where we need them for legal, safety, or abuse-prevention reasons.
- confirm you have the rights to anything you upload or generate for it, including its picture, and that publishing it does not violate anyone else's rights.
- accept the community guidelines.
no tolerance for objectionable content or abusive users. content is filtered before it is listed in the gallery. any user can report a character or block its creator from inside the app, and we act on reports within 24 hours. every report is reviewed by the folk team. we remove content and suspend or terminate accounts at our discretion, without notice, when we believe the guidelines or these terms have been broken. a suspended account cannot sign in to folk on any platform until we lift the suspension.

third-party services and AI outputs
folk depends on third-party infrastructure, messaging platforms, AI model providers, payment processors, and services you connect. we are not responsible for third-party availability, policies, or outputs.
AI outputs can be wrong, incomplete, delayed, or unsafe for a particular use. you are responsible for deciding whether to rely on an output or action, especially for important decisions.
availability and changes
we try to keep folk reliable, but the service is provided as available. we may change, pause, limit, or discontinue features as the product evolves, including integrations, models, channels, and automations.
termination and deletion
you can delete your account from settings → privacy. account deletion is intended to permanently remove data we control, including your sandbox, conversations, memory, and stored connection credentials, subject to backups, payment, fraud, security, and legal obligations.
we may suspend or terminate your account if you violate these terms, create risk, fail to pay, or misuse the service.
disclaimers and liability
folk is provided "as is" and "as available". to the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
to the fullest extent allowed by law, Nozomio, Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. our total liability for claims related to folk is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
changes, law, contact
we may update these terms. material changes will be communicated in the app or by another reasonable method. continued use after changes take effect means you accept the updated terms.
these terms are governed by Delaware law, without regard to conflict-of-law rules.
